By confirming a booking, paying a deposit, or using the services of 360 Booth Hire NZ, the client agrees to these Terms & Conditions.

A booking is confirmed once:
the required deposit or full payment has been received
a confirmation email has been provided by 360 Booth Hire NZ

To ensure our team can deliver the highest level of service while allowing sufficient time for safe setup, operation, and pack down, the latest available booth start time is 8:00 PM. Unfortunately, we are unable to accept bookings that commence after 8:00 PM.
Requests for a booth start time after 8:00 PM may be considered at the sole discretion of 360 Booth Hire NZ and, if approved, may be subject to an additional late-night service fee.
Clients are responsible for ensuring their selected booth operating time complies with this policy before confirming their booking.
360 Booth Hire NZ reserves the right to decline any booking that falls outside of its standard operating hours.

Payment is due by the due date stated on the invoice.
Full payment must be received no later than 7 days before the event date, unless alternative payment terms have been agreed to in writing.
Corporate clients may be invoiced on approved payment terms where agreed in writing by both parties.
We do not accept cash payments.
We accept the following payment methods:
Bank Transfer
Visa
Mastercard
Credit & Debit Cards
Afterpay
Clients wishing to pay by Visa, Mastercard, Credit Card or Afterpay must email info@360boothhirenz.com to request a secure online payment link.
Bookings are not considered fully paid until payment has been successfully received and cleared.
Failure to make payment by the invoice due date may result in the booking being cancelled or released to another client at the sole discretion of 360 Booth Hire NZ.
360 Booth Hire NZ reserves the right to refuse, suspend or cancel its services where payment has not been received by the agreed due date.
Any late payment arrangements must be approved in writing by 360 Booth Hire NZ before the invoice due date.
Chargebacks & Payment Disputes
Clients agree not to initiate a chargeback or payment dispute without first providing 360 Booth Hire NZ with a reasonable opportunity to investigate and resolve the matter. Where services have been delivered in accordance with the confirmed booking, 360 Booth Hire NZ reserves the right to recover any outstanding amounts, including any fees incurred as a result of an unsuccessful chargeback or payment dispute.

Client Cancellation
More than 14 days before the event - deposit may be transferred to another available date.
14 days before the event - deposit is not refundable.
Less than 14 days before the event - payments made are non-refundable.
Rescheduling is subject to availability

The client is responsible for providing:
a safe operating area
sufficient space for the booth
access to a standard power outlet within reasonable distance
protection from rain and adverse weather for outdoor events
If the venue is unsafe, we reserve the right to suspend or terminate the service without refund.

The client accepts responsibility for damage caused by:
intentional misuse
negligence
guests behaving dangerously
liquids, food or drinks spilled onto equipment
The client may be charged the repair or replacement cost of damaged equipment

A booth attendant will supervise the equipment during the booked hire period.
Guests must follow all instructions provided by our attendants.
We reserve the right to refuse service to anyone behaving aggressively, intoxicated or in a manner that may damage the equipment or endanger others.

Videos and Photos are typically delivered via an online gallery within the timeframe advised after the event.
Delivery times may vary depending on internet availability, event size and editing requirements.

Gallery retention is determined by the Touchpix platform.
Clients are strongly encouraged to download and back up all photos and videos immediately upon receiving the gallery link.
While galleries are generally intended to remain available for approximately six (6) months, the retention period is managed by Touchpix and may vary depending on the platform or system settings.
360 Booth Hire NZ does not guarantee that online galleries will remain accessible for any specific period and cannot guarantee the recovery of expired or permanently deleted photos or videos.
Once a gallery has expired or has been permanently deleted by the Touchpix platform, the media may no longer be recoverable.

We make reasonable efforts to back up event media.
However, due to the nature of digital technology, storage limitations, software failures or third-party hosting services, we cannot guarantee permanent storage of event media.
Clients are encouraged to download and securely store all files immediately after receiving the gallery.

Online Gallery Storage & Retention
To prepare your event, your event is created within our Touchpix event management system once your booking has been confirmed and the required deposit or full payment has been received.
Please note that Touchpix calculates its data retention period from the date the event is created within the Touchpix system, not from the date of your event or the date your online gallery is delivered.
Following your event, you will receive an online gallery link containing your photos and videos.
It is the client's responsibility to download and save all photos and videos to their own device or cloud storage as soon as the gallery link is received.
Once the Touchpix retention period has expired, the online gallery and all associated media files are permanently deleted from Touchpix's servers and cannot be recovered by 360 Booth Hire NZ or Touchpix.
360 Booth Hire NZ is unable to retrieve, restore or reproduce any deleted media once it has been permanently removed from the Touchpix system.
We strongly recommend downloading and backing up all photos and videos immediately upon receiving your gallery link to avoid permanent loss.

While every effort is made to provide uninterrupted service, we are not liable for delays or interruptions caused by:
power outages
venue internet issues
software failures
equipment malfunction
circumstances beyond our reasonable control
Where possible, we will use reasonable efforts to rectify the issue during the event.

Unless otherwise agreed in writing, 360 Booth Hire NZ may use event photos or videos for:
social media
website galleries
promotional material
advertising
Clients who prefer their media not to used for marketing purposes must notify us before the event.

The client agrees to:
provide accurate booking information
ensure guests behave safely
supervise children where appropriate
provide venue access at the agreed time

To the maximum extent permitted by New Zealand law, our liability is limited to the amount paid for the booking.
We are not liable for:
indirect losses
loss of enjoyment
loss of business opportunities
loss of profits
consequential damages
Nothing in these terms limits any rights that cannot legally be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986

We are not responsible for delays or cancellations caused by the events outside our reasonable control, including but not limited to
severe weather
natural disasters
government restrictions
civil emergencies
venue closures
power failures

Personal information collected during the booking process is used solely for:
managing bookings
communicating with clients
invoicing
delivering galleries
We will not sell or disclose personal information except where required by law.

These terms and conditions are governed by the laws of New Zealand.
Any disputes shall be subject tot the jurisdiction of the New Zealand courts.
